Terms of sale

These terms apply to every order placed through this shop. They are written for consumers. The identity of the seller and its registered details are in the imprint, and the same details apply throughout this page.

1. Scope and who we sell to

1.1 These terms govern all contracts of sale concluded through this online shop between us, as seller, and you, as buyer.

1.2 This shop sells to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. We do not currently offer business or trade terms, and orders placed for business purposes are not accepted through this shop.

1.3 The contract language is English.

2. How a contract comes about

2.1 Putting products on this shop is not a binding offer. It is an invitation to you to place an order.

2.2 You place your order by adding a product to the basket, going through checkout, entering your details, choosing a delivery and payment method and pressing the button that completes the order. Pressing that button is your binding offer to buy the goods in the basket.

2.3 Before you press it, checkout shows you the goods, the quantity, the price, the delivery charge and the total. You can go back through every step, change the quantity, remove an item or correct what you have typed, using your browser's back control or by editing the basket. Nothing is charged until you complete the order.

2.4 We acknowledge your order by email straight away. That acknowledgement records that we have received the order; it is not yet acceptance.

2.5 The contract is concluded when we dispatch the goods and tell you so, or when we expressly accept your order — whichever comes first. If we cannot accept your order, for example because the item is not in stock, we will tell you and nothing is charged.

2.6 We store the text of the contract and send it to you by email with your order confirmation. Keep that email: if you ordered as a guest, it is your copy.

3. Prices and delivery charges

3.1 Prices are those shown on the product at the time you order, in euro. They include VAT; the applicable rate, or the fact that the seller is a small enterprise under section 19 of the German VAT Act and shows no VAT, is stated in the imprint and at the foot of every page.

3.2 Delivery is charged on top of the price and is shown separately in the basket before you pay. The current rates are on shipping and returns.

3.3 Cosmetics sold by volume carry a unit price alongside the selling price, shown on the product.

4. Payment

4.1 The payment methods available to you are shown at checkout before you complete the order. Those we accept are also listed at the foot of every page.

4.2 Payment falls due immediately on conclusion of the contract.

4.3 Payment is processed by the provider you choose at checkout. That provider's own terms and privacy notice apply to the payment itself, in addition to these terms. We never see or store your full card details.

5. Delivery

5.1 We deliver to the address you give at checkout. We currently deliver within Germany.

5.2 Orders placed on a business day are dispatched within one business day; orders placed at a weekend or on a German public holiday are dispatched on the next business day. Standard delivery within Germany then takes 2 to 4 business days.

5.3 Where a delivery attempt fails for a reason within your control — in particular an address that was given incompletely or incorrectly — you bear the cost of the second attempt.

5.4 Full details, including what happens to an undelivered parcel, are on shipping and returns.

6. Right of withdrawal

As a consumer you have a statutory right to withdraw from the contract within 14 days. The formal instruction, the deadlines and the model withdrawal form are on right of withdrawal and form part of these terms. We do not rely on the statutory exception for sealed goods, so an opened bottle may still be returned.

7. Retention of title

The goods remain our property until they have been paid for in full.

8. Faulty goods

8.1 The statutory rules on liability for defects apply. For new goods sold to a consumer, the statutory limitation period is two years from delivery.

8.2 If something is wrong with what you received, write to shcommerce@outlook.com with your order number and a photograph. We will replace it or refund you at our cost.

9. Liability

9.1 We are liable without limitation for damage arising from injury to life, body or health, for intent and gross negligence, under the German Product Liability Act, and to the extent we have given a guarantee.

9.2 For slight negligence we are liable only where we breach an obligation whose fulfilment is essential to the proper performance of the contract and on whose fulfilment you may routinely rely. In that case our liability is limited to the damage typical for this kind of contract and foreseeable at the time it was concluded.

9.3 Liability is otherwise excluded.

10. Use of the product

The serum is a cosmetic product for external use on the upper lash line. Use it as directed on the carton and on the product page. It is not a medicine and we make no medical claim for it. If you have a condition affecting your eyes or eyelids, or you are pregnant or breastfeeding, ask a doctor or pharmacist before using it.

11. Governing law and dispute resolution

11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer habitually resident in another EU member state, this choice of law does not deprive you of the protection of mandatory provisions of the law of that state.

11.2 We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

11.3 The European Commission's online dispute resolution platform ceased operating on 20 July 2025, so no link to it is given.

12. Changes to these terms

The version of these terms in force when you place your order is the version that applies to that order. Changes published afterwards do not affect contracts already concluded.
